Terms of Service for the "Greener Than Yours" Application

1. General Provisions

1. These Terms of Service set out the rules for using the Greener Than Yours mobile application (hereinafter: the “Application”) and the rules for providing electronic services through it.
2. The owner and operator of the Application and the service provider is:

3. These Terms of Service are made available to the user free of charge in a manner that allows the user to review and save their contents.
4. Use of the Application constitutes acceptance of these Terms of Service.
5. The Application is intended for persons who are at least 16 years old.

2. Description and Scope of Services

1. The Application is intended to support users in planning and carrying out lawn care.
2. Application features may include, in particular:
   • planning lawn-care tasks,
   • recording information about the lawn and the user's activity history,
   • analyzing lawn photos using artificial intelligence technology,
   • generating lawn-care recommendations and plans,
   • presenting weather data for a specified location,
   • optional synchronization of planned lawn-care tasks with the user's device calendar,
   • optional in-app notifications and push notifications regarding planned events and activity in the Application.
3. The scope of available features may change as the Application is developed.

3. Testing Status of the Application

1. The Application is currently made available as a test version to a limited group of users.
2. During the testing period, some features may contain errors, operate with limited functionality or change as the Application is developed.
3. Access to the test version does not have a specified expiration date; however, during the testing period it may be changed or discontinued.
4. Feedback regarding the operation of the Application, errors and suggestions for improvements may be submitted using the contact features available in the Application or by email at contact@greenerthanyours.app.

4. Technical Requirements

1. Using the Application requires:
   • a compatible mobile device running an operating system supported by the current version of the Application,
   • Internet access to the extent required by features communicating with the server,
   • a current or supported version of the Application,
   • a user account for features that require signing in.
2. Some optional features may require granting appropriate system permissions, in particular access to the camera, calendar or notifications.
3. Failure to grant a required permission may prevent the user from using the feature to which that permission relates, but should not affect other features that do not require such permission.

5. User Account

1. Using some Application features requires creating a user account.
2. Signing in to the Application is handled through the external authentication system Auth0.
3. The user is responsible for the security of their account and for using it in accordance with these Terms of Service.
4. The following is prohibited:
   • sharing the account with third parties in a manner that may compromise the security of the Application or data,
   • attempting to gain unauthorized access to the Application, other user accounts, servers or other infrastructure components,
   • taking actions that interfere with the proper operation of the Application.

6. Entering into and Terminating the Use of Services

1. The user may review these Terms of Service before beginning to use the Application.
2. The agreement for the provision of electronic services with respect to Application features is entered into when the user begins using the relevant services after accepting these Terms of Service.
3. The user may stop using the Application at any time.
4. With respect to account-related services, the user may terminate their use by deleting the account in the Application.
5. If the user does not have access to their account, they may contact the Operator at contact@greenerthanyours.app.

7. Optional Device Integrations

1. Some Application features rely on optional device permissions, such as access to the camera, calendar or notification permissions.
2. These features are activated only in connection with an action by the user and after the relevant permissions have been granted, where required by the operating system.
3. The user may revoke system permissions at any time in the device settings, which may limit or disable the related functionality.

8. Artificial Intelligence

1. The Application uses artificial intelligence technology, including OpenAI services, in features such as:
   • analysis of lawn photos and generation of recommendations,
   • generation of lawn-care recommendations,
   • answering user questions in the Assistant with the selected context.
2. Results and content generated by artificial intelligence are provided for informational and supporting purposes.
3. Artificial intelligence technology may generate content that is incomplete, inaccurate or not adapted to all circumstances occurring in practice.
4. Recommendations generated by AI features and plans created by the Application do not constitute professional gardening, agricultural or other expert advice.
5. Before taking action based on generated recommendations, the user should consider actual conditions and, when using products or substances intended for lawn care, follow the instructions and labels provided by their manufacturers.

9. User Content

1. The user may submit content and information to the Application, in particular:
   • photos of the lawn,
   • information about the lawn,
   • data relating to lawn care and performed tasks.
2. The user represents that they are entitled to submit the content they provide to the Application.
3. Submitting unlawful content or content that infringes the rights of third parties through the Application is prohibited.
4. The Operator may process and store user content to the extent necessary to provide Application features, in accordance with the Privacy Policy.

10. Weather Data and External Information

1. The Application may present weather data obtained from external providers based on the location indicated by the user.
2. Weather data and information or recommendations based on such data are provided for supporting purposes and may differ from actual conditions at a particular location.

11. Liability

1. The Operator makes reasonable efforts to ensure that the Application operates properly; however, due to its nature, in particular its current testing stage, errors, temporary unavailability or technical interruptions may occur.
2. The user makes lawn-care decisions taking into account their own assessment of actual conditions, information concerning the products being used, and the informational nature of recommendations generated by the Application.
3. The Operator's liability is determined in accordance with applicable law.
4. Nothing in these Terms of Service excludes or limits consumer rights or the Operator's liability to the extent that such exclusion or limitation is not permitted under applicable law.

12. Account Deletion

1. The user may delete their account in the Application at any time.
2. Deleting the account terminates the provision of services associated with that account.
3. Rules concerning deletion and possible continued retention of a limited scope of data are described in the Privacy Policy and on the account deletion page.

13. Complaints and Reports Concerning the Application

1. The user may submit a complaint concerning services provided through the Application by email at contact@greenerthanyours.app.
2. To enable the complaint to be reviewed, the submission should contain a description of the problem and information allowing the relevant service or feature to be identified. If necessary to handle a report concerning an account, the user may also provide the email address associated with the account.
3. The Operator may ask the user to provide additional information if the complaint cannot be reviewed without it.
4. Complaints are reviewed without undue delay and within the time limits required by applicable law.
5. A response to the complaint will be sent to the email address used to contact the Operator, unless applicable law or arrangements with the user require another form.

14. Changes to the Application and Terms of Service

1. The Application is under development, and its features may therefore be added, changed or removed.
2. The Operator may update these Terms of Service, in particular in connection with changes to Application functionality, the manner in which services are provided or applicable law.
3. The current version of these Terms of Service is made available on the Application website.
4. In the event of material changes, the user may be informed of the new version of the Terms of Service or asked to accept it again if required due to the nature of the change.
